Terms of Service

These terms are an agreement between you (the business subscribing to NamastePOS) and NamastePOS ("we", "us"). By creating an account or using the service you accept them.
1. The service
NamastePOS provides point-of-sale, billing, kitchen display, QR ordering, customer management, and related tools for food businesses, offered as a subscription with a free Starter tier and paid plans. Features vary by plan and are described on the pricing page inside the app.
2. Accounts and staff
You must provide accurate business information and keep your credentials secure. Staff accounts and PINs are your responsibility — actions taken through them are attributed to your business. You must have the right to enter these terms on behalf of your business.
3. Subscription, trial, and billing
Paid plans are billed in advance (monthly or yearly) through Razorpay in Indian Rupees, plus applicable GST. New businesses receive a free trial; when it ends, paid features pause until you subscribe. You can cancel anytime — access continues to the end of the paid period. Fees already paid are non-refundable except where required by law. Prices may change with at least 30 days' notice.
4. Your data and your customers
Your business data (menu, orders, customers, invoices) belongs to you. You grant us the rights needed to host and process it to provide the service, per our Privacy Policy. Where you collect end-customer personal data through NamastePOS, you are the data fiduciary: you are responsible for collecting it lawfully and honouring customer rights, and we assist as your processor.
5. Tax compliance
NamastePOS generates GST-compliant invoices based on the rates, GSTIN, and settings you configure. You are solely responsible for the accuracy of your tax configuration, filings, and payments. NamastePOS is software, not a tax advisor.
6. Acceptable use
Don't use the service to break the law, send spam (including unsolicited WhatsApp/SMS marketing), infringe others' rights, probe or disrupt the platform, resell it without authorisation, or attempt to access other tenants' data. We may suspend accounts that do.
7. Third-party services
Integrations (Razorpay, Google, WhatsApp, SMS, food-delivery aggregators) are governed by their own terms. We are not responsible for third-party outages or actions, though we work to handle them gracefully.
8. Availability and support
We target high availability but do not guarantee uninterrupted service; the app's offline mode keeps core billing working during outages. Support is provided via in-app chat, WhatsApp, and email during business hours (IST).
9. Liability
To the maximum extent permitted by law, our total liability for any claim in a 12-month period is limited to the subscription fees you paid us in that period, and we are not liable for indirect or consequential losses, lost profits, or lost data beyond our backup obligations. Nothing limits liability that cannot be limited under Indian law.
10. Termination
You may close your account anytime from the dashboard. We may suspend or terminate for breach of these terms, non-payment, or legal necessity, with notice where practicable. On closure you can export your data for 30 days, after which it is deleted except records we must retain by law.
11. Governing law
These terms are governed by the laws of India; courts at Pune, Maharashtra have exclusive jurisdiction, subject to any mandatory consumer-law rights.
